Terms of Service

Welcome to Any Swing Golf. These Terms of Service ("Terms") govern your use of the Any Swing Golf facility, website, and related services (together, the "Services"). By booking a bay, joining a membership, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. ELIGIBILITY

You must be at least 18 years old to create an account, book a bay, or sign the liability waiver. Guests under 18 may use the facility only when accompanied by a parent or legal guardian who has signed the waiver and agreed to these Terms on their behalf.

2. ACCOUNT AND IDENTITY

We use your phone number as your primary identifier. You agree to keep your contact information accurate and to notify us if your phone or email changes. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account, including your door PIN codes.

3. BOOKINGS

A booking is a reservation for a specific bay, date, and time at the Any Swing Golf facility. The booking is confirmed only after payment is processed and a door PIN is issued. The PIN is personal to your booking and may not be shared. Sharing a PIN may result in revoked access, loss of the booking without refund, and account suspension.

4. PRICING

Prices are shown at the time of booking and include the bay rental for the selected duration. Member pricing applies only to active members in good standing whose account phone matches the booking phone at the time of payment. Prices may change from time to time. The price displayed during checkout is the price you pay.

5. CANCELLATIONS AND REFUNDS

You may cancel a booking at any time before the booking start time through your dashboard. Refund eligibility depends on how far in advance you cancel:

- Cancel at least the cancellation-window number of hours before the booking start time: full refund issued automatically to your original payment method (typically 5-10 business days to appear). - Cancel inside the cancellation window: no refund. The booking is cancelled, your PIN is revoked, and your bay is released.

The cancellation-window length is shown on your booking confirmation and in your account dashboard.

Membership fees are non-refundable for the current billing period. Specifically:

- Monthly membership ($20/month or current published rate): fees are non-refundable for the current month. You may cancel a monthly membership at any time; your membership remains active until the end of the current monthly billing period, after which no further charges are made. - Annual membership ($199/year or current published rate): the annual fee is FINAL SALE. No refunds are issued for the annual fee under any circumstances, including but not limited to cancellation, non-use, relocation, injury, or facility closure. You may cancel an annual membership at any time; cancellation stops the next annual renewal charge and your membership remains active through the end of the year you have already paid for.

By selecting the annual plan at signup, you acknowledge and agree that the annual fee is non-refundable.

Member pricing is provided for the member's personal use. To keep rates fair for all customers, Any Swing may apply standard (non-member) pricing to bookings that reflect unusually high volume or that are made on behalf of non-members. This never prevents you from booking; it affects only the rate applied to a given booking.

6. NO-SHOWS

If you do not enter the bay during your booking window (no door PIN entry event recorded), the booking is marked as a no-show. No-shows are not refundable.

7. ACCEPTABLE USE

You agree to use the facility only for its intended purpose and to follow all posted safety rules and any instructions from staff or signage. You will not damage equipment, harm other guests, or interfere with other bookings. You will not bring outside food, alcohol, or hazardous items into the facility unless explicitly permitted. You will leave the bay in the condition you found it. You are financially responsible for damage to bay equipment caused by misuse, negligence, or violation of posted rules.

8. VIDEO MONITORING

The facility is video-monitored 24/7 for safety, security, and operational purposes. By entering the facility you consent to being recorded. See our Privacy Policy for retention and use.

9. LIABILITY WAIVER

Use of the facility requires you to sign a separate Liability Waiver before your door PIN is revealed. The waiver is incorporated into these Terms by reference. You may review the waiver at /waiver before booking.

10. INTELLECTUAL PROPERTY

The Any Swing Golf name, logos, software, and content are owned by Any Swing Golf or its licensors. You receive a limited, non-transferable license to use the Services for personal, non-commercial purposes. No other rights are granted.

11. THIRD-PARTY SERVICES

The Services use third-party providers including Stripe (payments), Twilio (SMS verification), Resend (email), Verkada (door access), and Supabase (data hosting). Their handling of data is governed by their respective privacy policies. We are not responsible for outages or actions of those providers.

12. DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY SWING GOLF, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, REGARDLESS OF THE LEGAL THEORY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ANY SWING GOLF IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

14. INDEMNIFICATION

You agree to indemnify and hold harmless Any Swing Golf, its owners, employees, contractors, and affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

15. SMS NOTIFICATIONS

When you provide your mobile phone number and opt in at booking time (or in your dashboard), we may send you transactional SMS notifications about your bookings, primarily a one-time reminder containing your door PIN sent approximately five (5) minutes before your booking starts. We do not send marketing or promotional SMS through this channel. Message frequency is up to one (1) message per booking. Message and data rates may apply according to your carrier plan. To stop receiving SMS reminders, reply STOP to any reminder message or toggle SMS reminders off in your dashboard profile. For help, reply HELP or email Team@anyswing.com. Opting out of SMS will not affect any other part of the Services, including email confirmations or in-app access to your PIN. Mobile carriers are not liable for delayed or undelivered messages, and we do not guarantee that every reminder will reach you — always confirm your PIN via email or the dashboard if you have not received the SMS by your booking start time.

16. CHANGES TO THESE TERMS

We may update these Terms from time to time. Material changes will be posted at /terms with an updated version date. Continued use of the Services after the change takes effect means you accept the updated Terms.

17. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. You and Any Swing Golf agree that any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Santa Clara County, California, and both parties consent to the personal jurisdiction of those courts. To the maximum extent permitted by law, each party waives any right to a jury trial.
